Likeness Declaration

What this declaration is

You sign this declaration before you upload a photo, video or voice recording of a person, make a likeness, verify your identity, join Likeness Studio, or try clothes on a photo of a person. It is part of your FLAÜNTE User Agreement and adds to it; it does not replace it.

Who is in what I upload

I declare that: (a) I am who I say I am; (b) every photo, video and recording I upload is of me, or of a person who has given me written permission to upload it and to make images, video or audio of them on FLAÜNTE for the uses I make; (c) I keep that written permission and will show it to FLAÜNTE if asked; (d) every person in what I upload is at least 18 years old; and (e) I will never upload or use anyone else's face, body, voice or likeness without their consent, and I will stop at once if a person withdraws it.

Verifying my identity and Likeness Studio

The ID document and the live selfie I give are my own. I will not use anyone else's ID, a photo of a photo, a mask, a deepfake or any other trick to pass a check. I will not list, license or take bookings for anyone's likeness but my own. A public figure is listed only after FLAÜNTE's checks: through their verified representative, or by applying themselves with their own verified identity and proof that they control their official accounts — never by anyone else on their behalf.

Other people's photos

If I upload photos of a client or anyone else, I am responsible for getting their consent in a form that is valid where they live — including, where the law requires it, explicit written consent to processing their facial or biometric data (for example under the GDPR, or biometric privacy laws such as those of Illinois, Texas and Washington) — for telling them how their photos will be used, and for passing their requests to delete them on to FLAÜNTE.

Using someone's likeness without permission

Using another person's face, body, voice or likeness without their permission may be a crime, and it is a civil wrong in many places. Depending on where it happens, it can break laws on the right of publicity and personality rights, privacy, data protection and biometric data, deepfakes and digital replicas, intimate images, fraud, impersonation and identity theft, harassment and stalking, defamation and consumer protection. It can lead to criminal prosecution, fines, damages, court orders and imprisonment.

If we find, or are told, that FLAÜNTE has been used to misuse anyone's likeness, we will: remove the content; suspend or close every account involved and ban the person responsible from FLAÜNTE; keep the evidence, including account details, signed agreements, uploads, outputs, logs and payment records; and report it to, and cooperate with, law enforcement, regulators and the person affected, including by giving them information where the law allows or requires it.

You are personally responsible for any misuse of a likeness through your account, and for every claim, loss, fine or penalty that results from it.

If this declaration is not true

If anything I declare here is not true, FLAÜNTE may remove my content and likenesses, cancel licences, withhold payments connected with the misuse, close my account and ban me, keep the evidence and report me, as set out above. The person whose likeness was used may also bring their own claim against me.

To the maximum extent permitted by law, I will defend and indemnify the FLAÜNTE Parties against every claim, loss, fine, penalty and legal cost that arises from a false declaration or from my use of anyone's likeness, as set out in the User Agreement.
